Legal Question in Wills and Trusts in New York

looking for a copy of my fathers will and testament

I need help in finding a copy of my fathers will and testament,I am from Ontario Canada,and I don,t know where to turn.I am not getting any help from anyone in his family,I will pay whatever % ,I need some help in which direction I should go.Any information would help.Thank You

You can petition the court for a copy of the will. Because of your location, I would suggest you retain an attorney in the county where your father lived, and have the attorney file the appropriate motion.

If the will is being probated, the will must be on file with the court. You or your attorney need only inspect the records of the Surrogate's Court of the county in which your father resided.

Some preliminary questions would be:

(1) Do you know your father had a will?

(2) Is it being probated? In Ontario?

(3) Where was he residing?

(4) Where were his assets?
