Death of Mother

Approximately 13 years ago my mother established a checking account in both her's and my name. She is now 87 and in failing health. There is $40,000 in the account which she consider's mine and wants me to have upon her death. Does my step father have any rights to this money should my mother pass away? My mom is afraid he'll try to take the money from me even though his name is not on the account.

If it is a basic joint account, then you would receive all money at the time of your mother's death.
