Legal Question in Wills and Trusts in New York

Estate Question #2

I did inquire about this before; this is a second question about the same issue.

My husband�s uncle died three years ago, his estate has been liquidated; distribution of his assets is being held up by a lawsuit brought by a neighbor who claims she is entitled to a portion of the estate. There is supposed to be a case pending. I have tried for at least a year to get the status of the court case from the attorney representing the estate who was hired by my aunt who lives in another state. We cannot get any information from them; they are claiming that the lawyer has personal issues preventing her from working on this which should be cleared up soon.

We feel like they are deliberately not giving us answers.

Question:

Are we entitled to information about the pending court case; is there another way to find out the status without the lawyers cooperation? My father-in-law is deaf and cannot communicate with his sister who seems confused by the whole situation. Is the information we are looking for public knowledge and if so how can we find it?

Would this be considered a civil suit?

I suggest that you look at the file for the estate in the Surrogate's Court where the estate is being administered. This should furnish sufficient information to enable you to pursue your inquiry.
