Legal Question in Wills and Trusts in New York

I am the Executor of my father's Estate and I have an Executor Surety Bond. At the funeral of my father, my uncle asked me for six death certificates. Unaware of their purpose and grieving, I gave him the six death certificates. How can I check the usage of the six death certificates given to my uncle and if a Life Insurance Policy was taken out on my father without his consent or knowledge, naming my uncle the beneficiary? My father's residence at death was Monmouth County, New Jersey; my uncle resides in Brooklyn, NY.

Please accept my condolences on the loss of your father.

Well first you can ask your uncle what he needed the death certificates for, and you can ask him if there was a life insurance policy on your dad's life.

As a general rule no insurance company is going to insure a person's life without them knowing about it. The insured has to take a mini-medical exam and so forth.

You may be able to enlist the help of the Monmouth County probate court; I'm not sure as I don't practice in NJ.
