Legal Question in Wills and Trusts in New York

fiduciary negligence

my mom died intestate. my brother was appointed administrator. I live in another state. My brother has done absolutely nothing yet including sending me an inventory of her assets and it's been 6 years since mom died. What should I do? When I call him and ask when he's going to get things done he arrogantly answers ''I don't know.''

Re: fiduciary negligence

At this point you need to take it upon yourself to have him removed as administrator and either have the court appoint you or someone you trust in the area. This can include a bank representative, an attorney, etc. However, before you start going down this road, what is the value of the estate? If it's only worth a few thousand dollars than you need to make a decision...and that would be, is the cost worth it?
