How do I file to the court now my son is 18 to receive his trust funds

How do I file to the court to release the trust funds now my son is 18 and how long does it take my daughter only had to go to the bank and show her id

What kind of account is it; under a Will, gift to minor account, guardianship, etc.?

Call or visit the administration clerk at the Surrogate's Court.

You do not specify what type of matter called for the Court to establish the account; trust under a will or a living trust? Depending upon how and why the fund was created, is how you go about getting the funds released. If a trust, living trust or under a Will, there must have been a trustee designated in the document creating the trust. If the document specified the trust funds were to be distributed to your son when he reached age 18, a simple letter from him to the trustee, along with some verification of his having attained age 18 (birth certificate, drivers license, etc.) should be all that is needed. If, for some reason the funds are being held by the Court, not the trustee, an application will be required to be made to the Surrogate of the County where the funds are held. You could call the Surrogate to get assistance on how to proceed and what forms and documentation are required.
