Legal Question in Wills and Trusts in New York

Do i need a lawyer for a will? I have 3 kids, and i am married, I own a home and everything is going to the 3 kids

I am not certain whether you are asking whether you need a will or whether you need to have the will drafted by an attorney. In either event, I suggest that you have a will and that it be properly drafted and executed. Without a will, your assets would be divided between your children and your spouse (should your spouse survive you). There are also rules that prevent one from completely disinheriting a spouse. There would also be concerns as to how title to your home is held: Is it owned by both you and your spouse jointly with right of survivorship?

Estate planning is usually the biggest bang for the buck. It usually costs relatively little, as does a will, and, in the long run, pays for itself in what is saved by the estate.
