Legal Question in Wills and Trusts in New York

How long can will contest go on

If a person contests a will saying it was forged (document is 10 years old ) how

long can they contest in court before they need to show proof which there is

none because the will is genuine. Assets in my aunts estate cannot be

distributed until this matter is solved. How long will it take before a judge rules

on this and if there is no proof can the contesting party go to another court?

How long can this procedure go on for?

Re: How long can will contest go on

Unless some handwriting expert has provided some proof on behalf of the contesting party, the case can go as fast as it takes the Judge to schedule a hearing. If no positive proof has been presented, just a naked allegation, I suggest a motion to dismiss the contesting complaint, a request for fast hearing and disposal of the matter.
