Legal Question in Wills and Trusts in New York

property & lack of will

i live with my boyfriend and we're not spring chickens - if he dies of a heart attack tomorrow - can his children (who don't even have any contact with us) toss me out and take even the things that are mine? what are my rights? The house is not in my name and I'm not listed on any of his benefits - I believe that everything of HIS should go to his kids - but not my things too...

Re: property & lack of will

Q. can his children (who don't even have any contact with us) toss me out?

A. I would not be so crass, but ultimately the answer is yes, the children would be entitled to sole possession of the property.

Q. and take even the things that are mine?

A. No. The children are not allowed to take property belonging to you.

Mike.
