Legal Question in Consumer Law in North Carolina

Hello Lawguru,

I recently moved from Miaimi to Charlotte. Movers US-1 Van Line of Florida Inc are refusing to deliver my furniture unless I pay more than waht the quoted and I am been black mailed for it.

1. Oct 5th 2010 - My furniture and my 20 months old son's toys, clothes, highchair and all other daily household stuff is picked by movers on Oct 5th 2010.

2. I call couple of times to dispatch and all I hear is driver will call when he arrives to Charlotte. FInally I get Lisa Johnson of US-1 Van lines of Florida Inc on 26th Oct 2010 and she says for some reason my furniture is delayed because of other shipments, and will be picked from Miami on Oct 29 2010.

3. Driver arrives on Nov 1st 2010 and says the truck cannot come to the apt so I need to pay $150.00, that is for him not the company. I refuse to pay to Orlando the driver and he calls Lisa Johnson.

4. Lisa says they will charge me $375 for getting in smaller truck to get to the apartment and I tell her I have see trucks to these apartments all the time and I checked with property manager and they said they see big trucks all the time. But Orlando and Lisa do not listen to me. All they want is money from me. more than the agreed price of delivery.

5. Orlando the driver is trying to scam me and he tells Lisa Johnson, that he can come till 75 feet from the truck and he will unwrap in the middle of the road.

6. The contract is for door to door service, thats what we agreed to pay, dis-assembly, packing, loading, unloading, unwraping and assemble. Now driver says he will leave it on the side of the road.

7. I agree for that, I tell him leave it on the side of the road and I started calling my friends to help me. The driver leaves without delivering the stuff.

8. I call Lisa Johnson next day Nov 2nd 2010, she demands $900+ dollars for redelivery otherwise I will not get my stuff.

9. I tell her, I will pay the balance $682.00 and $150.00 because the driver is incomptenent and cannot drive and he is scamming me and trying to rip me off, Lisa says that I am not making sense and the furniture will be unloaded in NYC and will be put into storage.

I already paid over $700.00

What do I do? They have my furniture, my sons stuff, household stuff and blackmailing me for more money. I tried BBB but no response. This is beeen a month since I am having tough time with my son's stuff been held and I been black mailed. I am emotionally broken down and this is putting lot of pressure on my family.

Please advise.

Find an attorney and sue them. See if you qualify for legal aid. If not, hire an attorney. You can also try NC attorney General's consumer protection section. http://ncdoj.gov/Consumer.aspx
