Legal Question in Criminal Law in North Carolina

My boyfriend has been recently taken into custody by the police. He was found with the research chemical 2-CE on him. When tested, the chemical somehow tested positive as heroin. 2-CE is unscheduled where we live and it had been ordered through the mail. If the police either do not perform further chemical testing or further testing still reports it back as heroin, what would be the appropriate actions to take against this. I do not find it fair that they will try to sentence him for heroin possession when it was a legal, mail ordered substance all along. I am pretty sure I can obtain a receipt for the purchase of the 2-CE, would that help? This is unjust and I want to protect his rights and him from an unfair 10 year jail sentence. Any information or advice would be greatly appreciated.
