Legal Question in Family Law in North Carolina

Big problem!

Question my x-wife and I have a childsupport agremment that is not enforced by child-support. She called me demanding more money she says.''she will take me to court and demand more money''. The problem is that I have a small business plus I work a full-time job can child-child-support take money from my small business? I am not making enough money to quit my job and over half of my money goes back into the business. And what rights do I have? plus I live in ohio I have promise her I will increase the payments again once I start making more money. I increase the amount from $400-$465 and another in late november I only make $9.85 hour should I be paying more money?

Re: Big problem!

First, how is it that you and your ex have a support agreement that is not monitored by CSEA? Are you sure that they just haven't contacted you about arrears? If you do have a court or administratively ordered support agreement and you have been paying your ex directly, you could find that the state looks at your direct payments as "gifts" and will still expect you to pay back support.

If you do not have an valid state mandated support agreement, you may find that obtaining one is in your best interests.

Hire an attorney and have them review your situation.
