Legal Question in Civil Litigation in North Carolina

My roommate and I do not get along and we are currently trying to find a way to get out of our lease which is not an easy process. During the last couple of months, she has been constantly texting very rude things in order to make me feel bad about myself. Her dad is also my boss and she makes comments about how I don't care about my job and how bad I am at my job and how her dad never wanted to hire me (I have not spoken to her dad about any of this). The texting never stops even though I have asked her to leave me alone and to only text me if it pertains to bills. This situation is so bad that it is affecting my health as extreme stress causes me to loose my appetite and I have lost almost 10 lbs in the law couple of months. I have done some reading a recognize all of her texts as harassment. What can I do about this situation? If I file a police report, what exactly is that going to do to help me? Can I get a restraining order against her so that we are able to break our lease?

I don't see how a restraining order will help you break your lease. You may need one for other reasons, but it probably won't help you get out of the lease.

A restraining order will not help you get out of your lease. You cannot break a lease in North Carolina. You do not give the details, so I do not know what kind of lease that you have. Start by reading the lease. Is your name and her name on the lease? Are you both liable for the rent or if one person leaves, is only the person who stays liable? Does your landlord have any other units into which you can move? Failing that, can you find another tenant to take your place? How many months do you have left on your lease? Might it be smart just to tell the landlord that you want out and see if you can pay him 2 months' rent as liquidated damages?

As for the roommate, just ignore her. Why do you care what she says? If her dad wants to fire you, he can. NC is a right to work state and that means you can be fired for any reason or no reason, as long as it is not an improper reason, like because of your race, because you have jury duty or because you filed for worker's comp. or something like that.

Just ignore the texts and delete them if they upset you. Count the days till your lease ends. Annoy her by being cheerful. Kill her with kindness. She plays head games with you. Its time you started playing head games with her since she acts so childish, provided that you do not harm her or her property.

The best revenge is living will. She will not be able to stand it and you will drive her nuts. Now go out there and be bold!
