Legal Question in Insurance Law in North Carolina

possible suicide/insurance

A neighbor's husband may have OD'd on vicodin the other night. He was having problems with substance abuse, had a DWI or 2 in the past. He had also shot himself in the shoulder a couple of years ago. There was no suidide note or any other indication of suicide-he just went to sleep on the couch and his wife found him, same as she had left him, at 3am deceased. The police have already thrown around suicide as a possible cause of death, but they of course will not get the full insurance amount if this is stated on the death certificate. I think he's getting an autopsy done now. They have a 6 month old daughter who deserves that ins. $. What are the presedents for a case like this?

Re: possible suicide/insurance

There are lots of precedents for cases such as this. Your neighbor should contact an attorney as soon as possible to begin making sure that she can make her case, if the claim is denied by the insurer. These cases involving a suicide v. accidental death are very tricky, and the facts are very important.
