Legal Question in Landlord & Tenant Law in North Carolina

30 day notice to vacate

I lived in a unit and the landlord never did repairs, i didn't have hotwater for 3days, the cieling leaked in one bathroom for over 6months. My least was subject to end on 3/2/06, I didnt think I had to give notice but I did on 2/09 and left on 2/28. Now he's suing me for March rent saying not enough notice. the lease did have a 30day automatic renewal but that still wouldnt constitute a full month's rent due by me. I had spoken with him in late January by phone and told him I would not be resigning my lease. So I just needed to know am I liable for the entire month of March rent?

Re: 30 day notice to vacate

It depends upon what your lease said. I am assuming this is not federally subsidized housing. If you gave him written notice of the defects that needed repair, and he failed to repair it, then you might have a defense to breaking the lease early.
