Legal Question in Legal Ethics in North Carolina

Account arbitration

After enduring an extremely lenghty and drawn out proceeding that I believe was unnecessary, I have accrued an exorbitant legal bill for basically little service.

How can I go about initiating a request for arbitration between the attorney's office and myself to reach an agreement on what is fair to pay for those services?

Re: Account arbitration

In most jurisdictions (federal and states) you will find that if the contract you signed contains a clause indicating all disputes shall be settled by arbitration, the courts have pretty much uniformly required arbitration. The exceptions to arbitration in contracts with arbitration clauses are if the contract was fraudulently induced [ this exception varies]. Some jurisdictions hold that even if there is a claim of fraud this claim should also be resolved through arbitration. If there is no clause in the contract, I would suggest you contact the attorney directly, express your views and attempt to come to some resolution. If that's not fruitful and you believe you've been overcharged, you might wish to contact the local or State Bar Association.
