Legal Question in Real Estate Law in North Carolina

seller withdrawal

Is it possible for an agent to pursue advertising costs with a seller if the seller withdraws sale of a residential property that has had no offers placed before them that was not previously written into the contract? Can the agent say that the sellers are in breach of contract by no longer wanting to sell their property? The exclusive right to sell contract has expired as has the extended agreement of 180 days by 2 months and the agent is still trying to pursue advertising costs and saying that a proposal has to be done to terminate contract. Is this true?

Re: seller withdrawal

It doesn't sound true but you will need to consult with an attorney to look over the listing agreement and get the specific facts. Or you can call the NC Real Estate Commission and see if they can help you.
