Soil Erosion

We purchased a new house 8 months ago. Our house has an drain in the backyard. I ask the home rep. if we would have a problem with water because I did not want the house to flood. He assured me that it was plenty of drainage and call if we had a problem.When it rains there is an river in my backyard. The neighbor is thinking about suing us for water damage and erosion to his yard. The county told me that the home builder did the minimum to get by. The neighbor and the contractor he hired have been in my yard and they blame me for the problem and he wants me to fix it. Our house is not the only house who has a drain.

We live on the middle of the grade and he lives on the lower part. The water starts at the top of the hill. The land is stepped. Is the home builder responsable for this? They will not return my calls or honor anything they have promised. They sold us the house and never looked back. Can the neighbor who is looking for a law suit, sue me? The homeowners association who are lawyers says, no matter what it pertains to, it is not the homebuilders fault. They are well paid from us and nothing gets done. What can I do?
