transfer of real estate

how do i transfer my interest in a house and property over to my ex spouse,as she lives in another state, and will that clear me of any responsibility to afore mentioned property?

A deed transfers your interest in the property. However, there also has to be acceptance by your spouse. In addition, the deed would need to be recorded to make it effective as to third parties, etc.

However, you would need to consult with a family law attorney and/or real estate attorney about the advisability and consequences of doing so.

You would remain responsible for any deeds of trust secured by the property that have not been paid off. Your spouse would need to refinance and payoff the existing liens to remove you from any responsibility from paying the mortgage.

Depending on your specific situation, there may be other items you are responsible for (such as your portion of the taxes through the date you transfer the property).
