Federal Tax Liability

If my husband owed back taxes (business related) to the IRS before we were married (5 years ago), can the IRS take what is legally mine?

No, the IRS cannot take property that is legally yours to satisfy your husband's pre-marriage tax debt. There could, however, be problems with any property that is jointly owned by you and your husband.
