Legal Question in Traffic Law in North Carolina

7 yr. old speeding ticket in N.C.

I went to renew my Indiana D.L. this week and was unable to do so. I found out that a speeding ticket from 5/2000 was the reason. I did get a speeding ticket in N.C. at that time. The letter I got afterwards stated if I chose not to pay the fine, that I would not have driving priviledges in N.C. and that i would get 2 points against my driving record. Figuring I'd never be in N.C. again, I didn't pay the ticket.

I re-newed my Indiana D.L. in dec. 2003, and nothing was ever mentioned about the outstanding N.C. ticket. When I called the N.C. DMV yesterday, I was told that my D.L.# had been flagged since 11/00. Now, I have an expired driver's license, and I can't renew it until after I pay the fine & court cost from the ticket. I can't legally drive without a license. Had the letter advised me that nearly 8 years after the fact that this would come back to haunt me, then I would have taken care of it a long time ago. I also wonder why nothing was mentioned in 2003 at the time I re-newed my license? is there any thing I can do? I was told that the legislation that allows states to deny license renewal due to out of state speeding tickets was passed in 2002. Can they ding me for a ticket before that date?

Your best bet is to pay off the N.C. ticket and go get your new license. Fighting this will cost you several hundred dollars and you'll have to wait until the fight is over to be able to drive. Even then you might lose.
