can i use a prayer for judgement on a littering charge? it was for throwing a cigerette butt out the window.

Most people tend to forget that the use of a PJC is not an entitlement - it is at the discretion of the presiding Judge. So the answer to your question is maybe. If you know what the particular judge's requirements are in order to consider granting you a PJC AND if you know how to properly request one - it is possible. Our firm did a PJC for a Marine who was charged with a slightly more serious littering charge but we only did it because even a minor misdeameanor conviction would have cause him serious problems with his career in the Marine Corps. My point is, unless you have a compelling reason for using the PJC - you probally shouldn't. On occasion depending on District Attorney policy, you may be able to do a bit of community service - most likely picking up trash - to earn a dismissal. This option, if available would also keep you from having to pay court cost and would keep this charge off your record.
