Legal Question in DUI Law in North Dakota

DUI and accident

I rolled my SUV on 3/1/08 when the road conditions had compacted ice and the wind speed was gusting to 40 mph. A passerby called 911 and the arresting officer checked the vehicle asked if I needed EMS stated he smelled alcohol and that he was going to take me back to town for tests. At no time did he ask me what happened to cause the accident and did not indicate on my citation anything about an accident or what the road conditions were. My ticket only states drove of in actual physical control while under influence. The breathalyser recorded deficient results and I then had to go to the Hospital for a BAC and are waiting for the results so that I can be prosecuted for DUI. My insurance company totaled out the SUV and wrote me a check but no accident reports exsist to my knowledge. I have an attorney but am a little confused about this whole thing. Please help or advise.
