Where do I stand legally?

I brought my classic car into a body shop to have the quarter panels painted. I found out from someone else that they had stripped the whole car. I talked with them and said to paint it a different color, if they could do it for no more than $3500. 3 months later it was done-the cost $7484.23! They told me the reason it was more was because they had too many hours into it. The car had been in almost perfect condition! I talked with him and him him a check for $4,000, he would work with me on the rest. I left another check for a month or so later. I have repeatedly asked for a bill, with a breakdown. I still don't have one. I put a stop payment on the other check until I get one. Today I was served papers for small claims court. They also have $400 from an insurance check for damage to my pickup,they did work on it and were going to re-do it. They have put this off for over 4 months now.

If the laws are similar to California, the body shop must provide a written estimate of your repair costs, then they must document whether they received your written consent to perform the repairs at the price quoted, or whether you authorized the cost over the telephone. In California, if the shop did not get consent, they cannot obtain that cost from the court.
