confussed

i was rear-ended by 3 other vehicles,party cited's insurance is telling me that depending on the amount of damage to my car,by there claims adjuster will depend on how much medical they will pay???

You are entitled to get money to compensate you for any damages or injuries that are caused by the accident. You can sustain a serious injury even if there is no visible damage to your car! Make sure that your doctor is aware of all problems that you are having since the accident-problems sleeping, waking up at night, dizzines, headaches, stiffness, etc. You want all of these things documented in the medical records. The people who caused the accident are responsible and it is your doctor who should be making the decisions as to whether or not your problems were caused by the accident and how much treatment you need. I am sure that the adjustor was telling you how they would like to handle the claim. Little damage to the car=little money to you. Don't let them bully you. Several things need to be answered, first when did the accident occur. Second, what was the damage to your vehicle and what were the injuries that you sustained in the accident. The amount of damages to the the car is not an indicator of how much medical they will pay, that will depend on if the injuries were caused by the accident. Of course, there is no correlation between medical payments and damage payments for your car. Sounds like the agent is looking out for his/her company, which is his/her job, not taking care of you btw. You should be delivering estimates to that agent, and you shouldnt otherwise be dealing with them without a lawyer. Make sure that you are following each and every directive by your doctor if you were treated. Once you know the extent of your medical expenses, and you are certain that all of your injuries are healed, then you can start thinking about settlement, but remember that you only have a year to sue from the date of the accident for claims that you may have.
