my house

after i file how long will it be before i have to move out of my house. I am going to file in Oct and right now I am not behind. But my house payment goes up in Oct with my medical bill I am tried of fighting my house. I am just filing on my house

The bank has to file a foreclosure lawsuit against you in state court. After 28 days, if you do not respond, they will be able to file a motion for a default judgment. Getting this judgment can take another few weeks. After the judgment, the property has to be appraised and advertised for auction, a process which usually takes 6-8 weeks. In other words, it will take the bank a minimum of 4 months to get to a foreclosure auction.

Filing a bankruptcy while this process is pending will stop it while you are in the bankruptcy until the bank gets bankruptcy court permission to continue. This can add another 2-3 months to the process.
