Legal Question in Business Law in Ohio

kicked off cheerleading squad

My 17 yr old daughter is on a competitive cheerleading squad. She joined Dec. 18, 2006 -mid-season. I have paid fees of $892.50, competition fees, uniform and shoes not rec'd yet, mandatory booster, music, team fees, make-up, bow, future competition fees. She got kicked off the squad for tardiness. They have a very organized organization. Booster club and a Constitution that my daughter and I had to sign. They did not use the procedure in the constitution to kick-her off. It states after 9 times of tardiness she is suspended from the next competiton, than suspended from a national competition, than removed from the team. The Director and another coach made my daughter sign a letter stating she had been late and if late again would be removed from the squad. We were out of town for week with permission to miss practice and when we got back got a call stating not to come to practice that she hd been removed from the team. Also that a vote was taken involving the team members and she was voted out. They made up new rule and I as a parent were never informed of tardiness or the letter. My daughter never told me of either and neither did the coach. I want all my money back for breach of the constitution on tardiness procedure. Chances?

Re: kicked off cheerleading squad

I could not really give you chances without seeing the Constitution and figuring out exactly what procedure they used (or did not use). Also, what exactly did they have her sign? It might not have mattered since she is under 18, but it may play a role. Anyway, if you'd like please contact me so we can discuss this further.

Thank you!
