what responsibility does developer have?

our company was contracted to perform under a general contractor. two months into project osha shut down project due to asbestos. this led to serious delays in our ability to perform our contract according to schedule and ultimatley resulted in our failure to complete. the contract we signed was based upon our ability to perform without interruption and before other sub contractors began their scheduled work. the schedule was never adjusted for this loss of time. the asbestos abatement company contracted for this project was fined $160,000.00 by osha for several violations. our employees were exposed to extreme levels of asbestos. this situation has forced us to consider fileing bankruptcy. what can we do?

Show me the documents!

If you can prove that the delay caused by the asbestos and not other causes under your control,you may, depending on state, have a cause of action vs the general contractor for removing you from the contract. Did your contract coverthis situation? Did you use a standard AIA contract? Was the General bonded? See a contracts lawyerin your state and show him the documents.
