Who gets what?

I have a younger brother who is in a little over hishead with a relationship that is ending in a bad way. My brother and his girlfriend bought a condo together about 5 months ago. They unfortunately are now split up and in a fight about who gets what. First of all the condo they lived in was destroyed by a flood last month and they received 10,000 in insurance money back and 3,000 from FEMA by the government. My brothers ex now wants half of all this money and wants to go spend it on new cloths and a down payment on a car and personal items. My brother on the other hand does not feel that it should be done this way as the money was given to them as an insurance claim based on damages to the condo. My brother needs every bit of this money to rebuild his place. Can she get legal assistance to take half of the money from this or can he fight this based on needed repairs to the condo where the claim came from in the first place?

One or both of them need to sit down with a lawyer who might be able to mitigate this for them. Either could go right to court immediately.
