Purchase of Horse Trailer

In Ohio,January 6 2007 5pm. I signed a contract to purchase a horse trailer, I did not take possesion of trailer, it is still at the dealership. I wish to cancel the contract. Can I?

It depends. Does the contract allow you to cancel it before taking possession? When and how is possession to be taken? What are the consequences of breaching the contract? Why do you want to cancel? These are just some questions that go into answering your question.

Not unless it was a home solicitation sale or the dealer committed an unconscionable act or practice in connection with the transaction. Assuming neither is the case, you probably would be in breach of contract if you cancelled it. The contract probably has a liquidated damages clause. I would think you'd be able to reach some sort of compromise with the dealer though. Or maybe they wouldn't even try to hold you to the contract at all.

You may very well be on the hook, so it's time to start dealing with the person who sold it to you or thinking about re-selling it. You originally had three days to rescind the deal. I would be in touch with the seller.
