can a minor be be convicted of child pornography for recieving a phota of another minor with her top off , but her breasts fully covered

Well. . .this type of crime has not yet been settled by the courts. Whether the picture is deemed leud and lascivious would require more legal process. Without seeing the picture I would guess that it was not pornography. But you should hire a lawyer because this is a serious offense.
