plea bargain

my son took a plea bargain for his testimony in a murder trial, his co-defendent filed a appeal and won so he will get a new trial. they want my son to return to court to testify again and said if he refuse they can recharge him with the original charges which included the murder charge also. So if everything starts over can't his plea bargain be thrown out and he can renegoitiate a new plea deal. Also, will he need a lawyer when he returns to court. His sentence was 13 yrs. w/a gun spec. and this happened in 2005

A lot depends on what was said and/or written down with respect to the original plea agreement. without knowing more, I can give you no definitive answer. I would say it is possible that he may be in a position to get a better deal. He should definitely have a lawyer when he returns to Court. There is to much at stake not to have one.
