Adoption and Abandonment

My ex-husband has not seen my 2 children in over a year. I wanted to file for my new husband to adopt. I was told from a friend that it is impossible to prove that he has had no contact with them. How do I prove to the court that he has not seen nor called them in over a year? (ages: 13 and 10)

The same as in any other case. The court will rely on your testimony as well as any affidavit that the probate court requires you to complete that there was no contact with the kids. By the way did you receive child support. The court considers this "contact" for purposes of the adoption.
