Legal Question in Family Law in Ohio

divorce/ custody

I'm not yet legally seperated but have been on my own for 3 months now with my 3 kids full time there father is trying to claim he has them half the time so he can get half of my benifits, can I file for full custody now or do I have to wait till I get seperated or durring the divorce?

Once a divorce is started, temporary orders will issue pending the duration of the case. These will determine custody, support, and temorary division of assets during the time the divorce is pending in Court and before it is finalized.

As part of filing for divorce you can ask for full custody and support. The court will allocate custody and support on a temporary basis until the divorce is finalized.
