Legal Question in Family Law in Ohio

My divorce decree states that I get to claim my son on my income taxes and my ex-husband can claim our daughter. He has informed me that he plans to claim our son on his 2010 income taxes. Can he do this? Don't I have the legal right?

Hi,

Yes, if your decree has not been modified you have the legal right to claim your son. If you claim him as does your ex... then expect an audit and be prepared to show the IRS the Court order. Your ex will have a problem when this happens.
