Legal Question in Family Law in Ohio

Guardian of orphaned child in other state

A close friend has died. They had recently taken custody as the sole remaing parent. There is no will, however there has been verbal thoughts of ''What if??'' with different parties. We are willing to accept permanent custody and are being asked by remaining family members to do so. We live in MN and the child resides in OH. A 'Safty Plan' was put to paper when all involved parties were present to insure the childs best interests from current temporary residence to prefered permanent residence. In seeking permanent custody, now that we have returned home, what should we do?

Petition for guardianship in the juvenile court in the county where you live.

It would be pretty hard to do this without the help of a lawyer.

The first question is where was this "safety Plan" put in place, OH or MN. If in Ohio, the juvenile court may have already taken jurisdiction over the child. If that is the case, then you need to file an action here in Ohio (in either the probate or juvenile court). If not, for convience sake consult a lawyer in MN and have the case broguht up there.

The silent option is to see what child and family servcies do here in OH. If everyone wants you to have the child, the county may assist you in securing custody and/or an adoption. Further, with the adoption you may be eligible for some financial assistance to to the same.
