Paying a childs college fees

Is it a law that a parent, who has stated in a custody agreement, but the mother just inherited a part of 2.5 million dollars and owns 15 rentals and the father makes less than 20 dollars an hour, required by law to pay for that childs education in full? This child has failed once and has reentered college and is carrying a 1.9 GPA. She works only on the week-end and makes 300 dollars on average, but spends it on going out with friends, she is 21.

To the best of my knowledge there is presently no law requiring a parent to pay a child's college tuition. As a general rule, divorced parents may agree to split the cost of a child's college education. Again that agreement would be predicated upon the child actually going to college. Even if parents agree to split the cost of college of higher education, there are limitations on those costs--i.e. state colleges in the child's home state. There is some case law which has decided that if a parent in a divorce agreement agrees to pay for college and later decides not to pay, the child has no recourse against the parent as the child was not a party to the divorce agreement.

One must look to the separation agreement, however,the Court retains jurisdiction on any issues relating to the child. Therefore, due to the substantial change in financial position, one may be able to argue that the mother is in a better position to pay for college.
