Legal Question in Family Law in Ohio

Which State to File In

I was married in Ohio 4 years ago. I have lived in New York State until September of this year. I am now back in Ohio. Which state do I file in for an uncontested divorce (no minor involved).

Re: Which State to File In

You can file for a legal separation in Ohio immediately, as there is no residency requirement for that. If you want to file a divorce, you must have resided in Ohio for at least 6 months prior to date of filing. Where the marriage occurred is not relevant.
