Am I stuck here?

I was divorced in Lorain County on July of 2002. At the time I was living in Texas with my three children. I have since relocated back to the state of Ohio, with hopes that my new husband will be able to secure work here. At this point it is not looking good. I have custody of the 3 children and it's stated in the divorce document their father is referred to as a companion, not a shared parenting agreement. I called the courthouse and explained the situation, they informed me that I would have to file a notice of intent to relocate. Unfortunately my ex will not sign, their is no point of even asking. But I do remember the clerk telling me about it being shared parenting, but no where is it listing those words. I need help desparately. The 17 years of my marriage my spouse was abusive to me and my 3 children. I would hate to think he still has some sort of control. I do not want this to turn into a lengthy legal battle, I just want to know if I can take them back home to Texas, where they are happier.

It is necessary that your divorce documents be reviewed in order to provide you with the information sought in your e-mail. Generally, you would be required to file a notice to relocate and a motion to modify visitation. The Court would then set the matter for a full hearing.
