When auto air-bags fail- who at fault?

I was in an auto accident and was rear ended while driving my Honda Civic Lx by a Mini-Van. The calculated speed of the Mini-van upon impact was 35-40mph. My air bags never deployed, consequently myself and a passenger both suffered injury.

Is Honda liable?

Airbag failure is a possible grounds for a product liability claim. Review by an expert is necessary, and workup of extent of damages is also warranted to see if economical to pursue litigation.
