Legal Question in Legal Malpractice in Ohio

my son dies at Akron General Hospital

My son went thru cartivasscular surgery in Sept. 2001 for artery replacement in legs then went back in Sept 2002 for repairs. Due to the repairs went into a coma for 45days with unknown blood loss. The doctor neglected to check for normal aorta blood flow back to the heart. Went back and forth to hospital with pain and blood loss. Sent back home after blood transfusions with pain killers died Nov 1 2002 with coroner stating no blood flow back to heart. What can I do? One attorney said that the hospital, doctor, surgeon, would have to be paid first. Please get back to me. Thank you.

Re: my son dies at Akron General Hospital

I am very sorry for your loss. The medical records concerning your son's surgery and the records concerning the complications will need to be obtained to determine whether his death was due to substandard or negligent medical care. We will also need to consult with appropriate expert witnesses outside of the Akron or Greater Cleveland area to determine if there is merit to our claims. A copy of the autopsy and his medical records before his surgery will also be important as well as a detailed medical history. If you are interested in having me investigate this matter for you please call or visit my web page at www.beckermishkind.com There is no attorney fee unless a settlement or verdict is obtained and depending on the circumstances we will obtain the necessary medical records to investigate this matter for you. I am not sure what the other attorney means when he told you that the hospital, doctor, surgeon, would have to be paid first. I suspect he meant that you would have to pay for all of the medical records in advance.
