Legal Question in Personal Injury in Ohio

Judgement in NJ

I have a case against me in NJ , the man claims owe him almost 15,000. I cannot make it to NJ for the trial. If he is awarded a judgement, I have a question. In Nov. I had a house fire, I am currently rebuilding my home with the insurance money which I get in payments as the work progresses, can he try to claim this insurance money? It is not my money, I only get it after an inspector checks the progress of work on the home.

Re: Judgement in NJ

My first question would be why you are being sued in New Jersey instead of Ohio. Did something happen in New Jersey? You must have contact with a state in some manner for the state courts to have jurisdiction over you.

Secondly, I am not sure why you are getting your money in payments and would have to review the policy to determine who has ownership of the money. Just because you are getting the money in payments may not mean that you are not entitled to the money; however, if the money is not held in your name, then it would be difficult for a creditor to locate it.
