wrongful death lawsuit

What would be the difference in filing a legal suit against a nursing home for ...nursing home neglect or wrongful death?

Also, if medicaid was involved with care...could they come back on an estate to claim an interest in the settlement?

If the nursing home was negligent or failed to provide proper care, the patient may have a case against the nursing home.

If the improper care or neglect causes the death of the resident, the family may bring a wrongful death action against the home.

In most cases of neglect, you have both a case for the neglect and the wrongful death because the resident suffered due to the neglect before eventualy passing away.

There is a one year time period on the neglect and a two year time limit on the wrongful death.
