Fence encroachments

There is a fence 3 ft on my property (deed shows this) but neither myself nor my neighbor can remember how long its been there (several years) or what was there before. What will we have to show to prove our arguements?

Adverse possession rules in Ohio would require that the fence be in place for at least 21 years before you can be required to allow it to remain on your property. That is the starting point. There are other issues, but none shorten the 21 year requirement.
