Legal Question in Real Estate Law in Ohio

Mistaken lien on my property

My brother and I are equal co-owners of our home. There's a lien attached to my home in my name only. The lien is based on Federal income tax liability (incorrect; I received rightful tax refunds each year listed) and a medical judgement (I was not treated at that hospital--or any other--at the time in question.) I believe it is money owed by another person with my name (I have a moderately common name) and was mistakenly attached to my property, possibly through my bank. How do I track down who I need to find to clear this from my record and off our property? My brother was denied a loan due to the lien; that's the only way we found out about it. I don't owe this money. Please help!

Re: Mistaken lien on my property

As for the lien for medical services, you can file a motion with the court requesting that the judgment be set-aside due to a mistake. You will need an attorney to do this.

As for the income tax lien, I would suggest you contact the taxing authority that placed the lien on your property, and attempt to make them aware that you are not the same person. You may be able to do this yourself, but an attorney would be helpful.
