Legal Question in Wills and Trusts in Ohio

father passed with no will has a wife (not my mother)lives in Ohio in probate now I am left out of the loop she has turned in inventory and is lying about the inventory moving stuff out of house storing it else where. Father died of head injury at work. Dad worked for the city, street crew 26 years. 1 year prior to that he was involved in a accident on the job hit by a trash truck contracted by the city case still on going. I am left out of the loop on it as well. I can not prove any of the belongings in the house or what he wanted me to have and or deserve to have.

I am so sorry about the loss of your father. If your father died without a will, the probate statutes govern how his estate will be distributed and it does not allow his surviving spouse to receive his entire estate. It would depend on how many siblings you have and if she is the mother of at least one of them.

As an heir, you are entitled to notice of everything that is filed at probate and most filings require your signature on a waiver or are set for hearing that you should receive notice. If she is working with an attorney, you should contact that person with your issues. You are also entitled to retain your own counsel to protect your rights to this estate. I would advise you to find a local attorney who specializes in probate law and get your case and you rights evaluated.
