Legal Question in Wills and Trusts in Ohio

Ex husband's estate and back child support

Estate of my ex-husband who recently passed away. I have lived in Virginia for 16 years now, my ex resided in Akron, Ohio. I never partitioned him for child support nor did I name him as the father on the birth certificate(the hospital did however record him as being the father at the time of childs birth) He was also named as father before my childs birth when I applied in 1982 for ADC. Child did get to visit him this past August and his work related accidental death has been very hard on child. My child has also been acknowledged recently in father's obituary. I would like to try to collect back child support for my child along with making sure child is included along with half sister in any estate issues. Their father never had children with his current wife of 7 years. I hope you can assist or direct me properly.

Re: Ex husband's estate and back child support

You can petition the estate for back child support. However, if the accident was work related, you may be able to go after the employer or go after the tortfeasor.

If you have any further questions pease feel free to call me at 330-762-1199. My office is in Akron, Ohio.
