Legal Question in Wills and Trusts in Ohio

Irrevocable trust

My mother named my sister in an irrevocable trust several years ago. She lives with my mother in Ohio. I live in Illinois and we would like for her to come live with us. Can I become her legal guardian even though I am not named in the will as executor or beneficiary?

Re: Irrevocable trust

Whether you are the executor or a beneficiary makes no difference to whether you can be your mother's guardian.

The trustee who manages your mother's money will need to make arrangements to pay any authorized expenses you incur on your mother's behalf. These expenses would be ordered or approved through the guardianship court (probate court in Illinois).

Good luck to you.
