Legal Question in Wills and Trusts in Ohio

My mother passed away and I have a transfer on death deed. what other paper work need to be done. One lawyer says he need s to file several papers and it will cost several hundred dollars to transfer the house to my name. Another lawyer said their should not be much cost because I have the transfer on death deed.

You will need to record a certified copy of the death certificate along with an affidavit relating to the facts of her death and your information as the transfer on death beneficiary. Also, the Recorder may require you to complete and provide a form that goes to the Medicaid Recovery Administrator to determine if the Administrator has a claim to recover any Medicaid she received. This is important even if she did not receive Medicaid. Finally, there is an Ohio estate tax form that needs to be prepared and filed certifying that no Ohio estate tax is due (assuming her estate is under $338,333.) The recording fees would be under $100 and the lawyer fees should be no more than $500, assuming this is all that needs to be accomplished.
