Legal Question in Workers Comp in Ohio

I was injured on job in 2003, have been approved for a total knee replacement, at this time have requested a lump sum settlement instead, my question is my former employer has sold the store to a new owner the new owner has refused to sign the C240 request, what options do i have if any at this time.

Hello,

You are dealing with a very difficult issue. My first concern would be that you sound like you require further treatment on the knee. Be aware that a settlement will foreclose your ability to get treatment for the work-related injury in the future.

Within the first 5 years, the employer is required to sign off on the C-240. After 5 years from the date of injury,the BWC can settle a claim without the signature of the employer.
